Terre Haute Man Charged with Providing Marijuana to Prison Inmates
INDIANAPOLIS—Kevin D. Shively, 39, Terre Haute, Indiana, at the time a Bureau of
Prisons employee, was charged with providing contraband in prison, announced Timothy M.
Morrison, U.S. Attorney, Southern District of Indiana, following an investigation by the
Department of Justice, Office of the Inspector General and the Federal Bureau of Investigation.
The information alleges that on or about October 2008, Shively provided marijuana, to
inmates at the Federal Correctional Complex in Terre Haute, Indiana.
According to Assistant U.S. Attorney James M. Warden, who is prosecuting the case for
the government, Shively faces a maximum of five years in prison and a $250,000 fine. An initial
hearing will be scheduled before a U.S. Magistrate Judge.
An information is only a charge and is not evidence of guilt. A defendant is presumed
innocent and is entitled to a fair trial at which the government must prove guilt beyond a
reasonable doubt.
