Timothy M. Morrison, United States Attorney for the Southern District of Indiana,
announced that ANDRE D. BENNETT, 33, an inmate at the Federal Correctional Complex,
Terre Haute, Indiana, was sentenced to 5 years imprisonment today by U.S. District Judge Larry
J. McKinney following his guilty plea to assault resulting in serious bodily injury. This case was
the result of a investigation by the Federal Bureau of Investigation and Federal Bureau of
Prisons.
On June 13, 2007, BENNETT, during mutual combat with fellow inmate James Russell,
kicked Russell in the head. Russell was pronounced dead due to blunt force trauma later that
day. The legal definition of the term “serious bodily injury” includes a substantial risk of death.
According to Assistant U.S. Attorney James M. Warden, who prosecuted the case for the
government, Judge McKinney also imposed three years supervised release following
BENNETT’s release from imprisonment.
