FEDERAL
GRAND JURY RETURNS INDICTMENT
Hammond, IN-The United States Attorney's Office announced that a Grand
Jury sitting in
Hammond, Indiana, returned the following Indictments on May 2, 2007:
TIMOTHY
N. FRAZIER, age 28, NAKIA L. COLEMAN, age 25, of Gary, Indiana and KENNETH
S. HICKS, age 39,of Ford Heights, Illinois, were charged in an eight count
indictment with knowingly and intentionally possessing with the intent
to distribute and distributing five grams or more of a mixture and substance
containing a detectable amount of cocaine base, commonly called crack
cocaine, a Schedule II controlled substance. If convicted on any of the
counts, the defendants shall forfeit any and all property obtained as
a result of the violations and any property used to commit the violations,
to include $5,307.75, a SAR 7.62x39 assault rifle, a Remington rifle,
model 1100, a 1994 Cadillac Deville and a 2000 Dodge Durango. This case
is being investigated by the FBI/GRIT Task Force. This case has been assigned
to and will be prosecuted by Special Assistant United States Attorney
Jacqueline L. Jacobs, who can be reached at 219-937-5500 for any inquiries.
CHAD
E. HARVEY, age 27, of Griffith, Indiana, was charged in a one count indictment
with being a felon in possession of a firearm, to wit: a Ruger .22 caliber
handgun loaded with six rounds of .22 caliber ammunition. If convicted
of this offense, Harvey will forfeit any and all firearms and ammunition
involved in this offense. Harvey had been convicted of Possession of Cocaine
in 2003, Criminal Recklessness in 2004 and of Theft in 2006. This case
is being investigated by the ATF/HIDTA Task Force. This case has been
assigned to and will be prosecuted byAssistant United States Attorney
Nicholas J. Padilla, who can be reached at 219937-5500 for any inquiries.
The
specific sentence in each case to be imposed upon conviction will be determined
by the judge after a consideration of federal sentencing statutes and
the Federal Sentencing Guidelines.
The
United States Attorney's Office emphasized that these indictments are
merely allegations and that all persons charged are presumed innocent
until and unless proven guilty in court.
